Sub: Grant of MACP ignoring promotion availed
through competitive examination.

Kindly find attached here with Memo No.
B2/MACP-III/Dlgs/2016, dated 22.03.2017 issued by SSPOs, Chennai City North
Division granting MACP-III to Sri D. Sivakumar, (an LGO) and Retired SPM, Madras
Medical College S O, Chennai – 600003 under Chennai City North Division.
The official was promoted
to PA cadre from 12.11.1977 through competitive examination. He was granted
TBOP on 15.11.1993 (now MACP l) and granted BCR (now MACP ll) on 1.1.2004. He
had been debarred to get MACP-III in the light of instructions contained in OM
No. 4-7/MACPS/2009-PCCC, dated 18.09.2009 which was challenged in the Hon’ble CAT, Madras Bench. Being failed in CAT, Madras Bench, the
official moved to Hon’ble Supreme Court of India which finally ordered that
promotion through competitive examination should not be counted as MACP and
thus now Sri D.Sivakumar got MACP – III.
The above memo is quite self-explanatory.
As such, this Circle Union would like to suggest for taking
immediate necessary steps to generalize this order so that thousands of such
LGOs debarred from getting MACP-III throughout India will be benefited.
Kindly analyze, on behalf of AIPEU, Group-C, CHQ / NFPE, if we can challenge this order even in the
Hon’ble Supreme Court of India directly for the benefit of the mass.
